GENERAL TERMS OF USE FOR Bikely®

1 General
These terms apply to the use of our services for bicycle storage, as well as the use of our mobile applications (the "app") and online services.
Use of Bikely® requires that you accept these terms. You accept the terms by creating a user profile, or otherwise using our services.
These terms and conditions can be updated from time to time without this being notified separately. You can find the current version of the terms at www.Bikely.no.
2 About Bikely®
Bikely® is a service that gives users access to storage solutions for bicycles in urban environments or other private or public areas. The services include access to individual lockable lockers for storing individual bicycles ("Bike Lockers") and access to shared solutions where several bicycles can be stored in a common area without individual lockable lockers ("Cycle Hotel") (collectively referred to as the "Services").
The dimensions of the bike lockers follow the Norwegian Road Administration's standard requirements and further information about measurements is described in the FAQ in the app or on the website.
3 Conditions for creating a user and accessing the service
To use the Services, you must meet the following conditions:
a) You are 13 years of age or older
b) You agree that it is your responsibility to keep the password to your account secret, as well as to check that your own account is not misused in any way.
c) You understand that your account is personal, and shall not be used by anyone else, not even with your verbal or written permission.
For guardians who create user access for minors under the age of 13, the guardian warrants that they have the legal opportunity to give consent on behalf of minors, i.e. that they have parental responsibility and/or the necessary consent from the person who has parental responsibility for the user in question.
Violation of terms may lead to exclusion.
4 Your account
Each user can only create one personal account. The user themself is responsible for the security of their account, for example ensuring that the password does not go astray and that others are not given access to the account. We are not responsible for any loss or inconvenience resulting from misuse of your account.
5 Personal data
We respect your right to privacy, and all processing of personal data takes place in accordance with Norwegian privacy legislation and in accordance with our general privacy policy. When registering as a user of the Services, you will be asked to consent to our processing of personal data in accordance with our privacy policy.
6 Access to and use of the Services
The following rules apply to the use of the Services:
(a) When using our Bicycle Lockers or when parking in our Bicycle Hotels, all users are responsible for ensuring that the door is locked when leaving the locker or the area. All users are encouraged to contact us in the event of lock errors or other problems related to the use of our services.
(b) Bicycle lockers and spaces in the Bicycle Hotel can only be used by the user themself and cannot be used for any form of commercial activity (rental, advertising, etc.).
(c) It is strictly forbidden to stay in Bicycle Lockers or Bicycle Hotels beyond what is necessary for the placement and retrieval of bicycles and equipment.
(d) Bicycle lockers and space in the Bicycle Hotel can only be used for bicycles and related equipment and cannot be used for storing other items, including flammable materials, chemicals or other things that may be harmful to the health of people or animals.
(e) It is prohibited to attempt to "hack" or test the security or configuration of any of our Bicycle Lockers or access solutions for Bicycle Hotels. This could be considered attempted burglary and lead to criminal prosecution.
(f) The user is responsible for showing due care when using our Bicycle Lockers and Bicycle Hotels and is responsible for loss or damage as a result of improper use, vandalism or similar caused by the user.
(g) The user depends on access to a mobile device (phone/tablet) for the administration of the Services and is themself responsible for using the latest updated version of the device's operating system and the latest version of the app at all times. The rental period runs until the rental relationship has ended in the app and the user is responsible for having electricity on their mobile device, see point 10.
Special requirements may apply for the individual installation and this is then indicated by notices on the location or via the app.
The user may be held financially responsible for loss or damage that we, or other third parties, may suffer as a result of a breach of these guidelines.
7 Prices, opening hours and availability
Prices for the use of the Services may be indicated on notices or in another clear way in connection with the individual location, and at all times at each location in the app. The remuneration will normally be stated per hour of storage time started, but deviations may occur. Rent accrues until the user has ended the rental period in the app. This applies even if the bike has been collected without this being indicated in the app.
In the event of technical problems in connection with the collection of a bicycle or equipment (faults on locking mechanisms , etc.), our service provider can be contacted for assistance and help will normally be available within 1 hour of the fault being notified. Further contact information can be found in the app or by posting on the location.
The maximum rental period is 7 days. If the bicycle or equipment is not removed by the end of the rental period, the bicycles and equipment may be removed at the user's expense and left to Falken or another third party. There will also be an infringement fee as described in more detail in the app or when posted on the location.
8 Rent, rental period and remuneration etc.
Rental prices are indicated at the location where the user uses the Services. The prices are stated including VAT per relevant time unit (hour/day).
9 Intellectual property rights
All content on our websites and App, etc., is our property and is protected according to, among other things, copyright, marketing and trademark laws. This means that trademarks, company names, product names, texts, computer code, images/graphics, design and layout and other content on the website and/or app cannot under any circumstances be copied or used in any other way without this being explicitly permitted by mandatory legislation or after express prior written consent from us.
10 Limitations of liability and the user's own risk
The services may be unavailable, in whole or in part, during certain periods due to repair, technical maintenance or error correction, and this will be indicated by notices on the relevant location and/or app. The same applies to access to the app or our online services. We do not have any form of responsibility for losses that the user may incur by not being able to access the Services.
The user is themself responsible for damage that they incur through their own use of the Services. This includes, among other things, crushing, falling or impact injuries when entering or exiting a bicycle and equipment, including related to poor lighting, incorrect signage or local road conditions.
We do not assume any form of responsibility for loss or damage to bicycles or equipment that is linked to water ingress, ice formation/frost, flooding or other circumstances beyond our control.
11 Security, theft, insurance coverage etc.
We are responsible for ensuring that our Bicycle Lockers and Bicycle Hotels provide a reasonable level of safety for users and bicycles/equipment. It cannot be ruled out that break-ins or thefts may occur and we have no financial responsibility for loss or damage in such cases unless it can be demonstrated that we have acted intentionally or grossly negligently in connection with the delivery of the Services.
In such cases, loss and damage for the user will normally be covered under the user's insurance arrangements (contents insurance etc.).
